Court returns CBI's papers for attaching Jagan's properties

                                                                                                                   
A city civil court on Monday returned papers filed by CBI seeking to attach hundreds of properties of three companies belonging to Kadapa MP Y.S. Jaganmohan Reddy and those of his former aide N. Sunil Reddy and Trimex group chairman Koneru Prasad, after raising certain objections.
The court asked the investigating agency to meet the objections within a week before going ahead. The court also returned the caveat filed on behalf of Mr. Jaganmohan Reddy on Saturday, pointing out deficiencies in the petition.
He was also given the same period to comply with the instructions.
Sources said the CBI listed out properties equal to the tainted amount in the three charge-sheets filed in the case against Mr. Jaganmohan Reddy so far.
But the court raised an objection that the list did not contain particulars of scheduled properties that were sought to be attached in relation to his companies – Jagati Publications, Indira Television and Janani Infrastructure.
As the properties were spread out in different districts of the State, the court asked the CBI to explain whether it had jurisdiction over such places since it was supposed to be for litigation in the city.
The court also took objection to the CBI referring to the properties as ‘benami' instead of attributing them to the respondents.
The court asked the CBI to clarify whether there were third party claims on the properties that were named. The discrepancies in the identity of vakalatnama holder and the petitioner and the failure of CBI to pay the process fee were also pointed out by the court.
In the case of caveat seeking notice to Mr. Jaganmohan Reddy before initiating attachment proceedings, the court asked him to clarify on what basis he sought the relief in a vacation court; whether he wanted it to be before the designated chief judge as ‘persona designate' or chief judge court.
He failed to enclose the government order permitting attachment of his properties.
The court asked Mr. Jaganmohan Reddy to specify how a caveat was maintainable without referring to the grounds for relief.
It also sought from him identity of properties against which relief was sought.
